Please read these Terms and Conditions ("Terms") carefully before using the eSalahKaar mobile application ("App") operated by Labhakarini InfoTech (P) LTD ("Company", "we", "us", "our"), a company incorporated under the laws of India.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. DEFINITIONS

1.1 "App" means the eSalahKaar mobile application available on Google Play Store and Apple App Store, including all updates and modifications.

1.2 "User" or "Aspirant" means any individual who creates an account on the App to seek MBA guidance and consultation services.

1.3 "Consultant" means a verified current student or recent graduate of a recognized Indian B-school who provides guidance services through the App.

1.4 "Session" means a paid 1:1 consultation between a User and a Consultant, conducted via voice call or text chat through the App.

1.5 "Wallet" means the in-app digital wallet maintained by the Company for each User, used to pay for Sessions and receive refunds.

1.6 "Platform Fee" means the commission charged by the Company on each Session, currently set at 25% of the Consultant's base fee.

1.7 "GST" means Goods and Services Tax as applicable under Indian law, currently at 18% on consulting services (SAC Code: 998313).

2. ELIGIBILITY

2.1 You must be at least 18 years of age to use the App.

2.2 You must provide a valid Indian mobile phone number for account creation and verification.

2.3 By creating an account, you represent that all information provided is accurate, current, and complete.

2.4 The Company reserves the right to refuse service, terminate accounts, or cancel Sessions at its discretion.

3. ACCOUNT REGISTRATION

3.1 Accounts are created using phone number verification via One-Time Password (OTP).

3.2 You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3.3 You must notify us immediately of any unauthorized use of your account.

3.4 One account per phone number. Multiple accounts are not permitted.

3.5 Account deletion is available through the App's Settings. You must withdraw all wallet balance before deleting your account. Any active bookings will be cancelled and refunded before deletion proceeds.

4. SERVICES

4.1 eSalahKaar provides a marketplace platform connecting MBA aspirants with verified B-school student consultants.

4.2 The Company does not provide consulting services directly. Consultants are independent service providers, not employees or agents of the Company.

4.3 The Company does not guarantee the accuracy, quality, or outcome of any guidance provided by Consultants.

4.4 Sessions are available in two formats:

  • (a) Scheduled Sessions — 15-minute fixed duration, booked in advance for a specific time slot (voice call or chat)
  • (b) Instant Calls — on-demand calls with online Consultants, billed per minute

4.5 All session times are displayed in Indian Standard Time (IST).

5. PAYMENTS AND PRICING

5.1 Users pay for Sessions through the in-app Wallet. The Wallet can be topped up using UPI, debit cards, credit cards, or netbanking via our payment partner Razorpay.

5.2 Minimum wallet top-up amount: ₹50.

5.3 Each Consultant sets their own per-minute rate. The Company does not impose minimum or maximum rates.

5.4 The total amount charged to the User is calculated as:

Total = Consultant Rate × Minutes × (1 + Platform Fee %) × (1 + GST %)

Example (₹20/min, 15-minute session):
Consulting fee: ₹300.00
Platform fee (25%): ₹75.00
GST (18%): ₹67.50
Total: ₹442.50

5.5 For Scheduled Sessions, the full amount is pre-paid at the time of booking.

5.6 For Instant Calls, a minimum wallet balance equivalent to 5 minutes at the Consultant's rate (including Platform Fee and GST) is required to initiate the call. Billing begins when the Consultant picks up and partial minutes are rounded up.

5.7 Unused wallet balance remains in the Wallet indefinitely and does not expire.

5.8 All payments are processed in Indian Rupees (₹).

6. REFUND AND CANCELLATION

6.1 Full details of our refund and cancellation policy are available at our Refund Policy page.

6.2 Summary of key refund rules:

  • (a) User cancels before deadline (2 hours before session): 100% refund to Wallet
  • (b) Consultant cancels at any time: 100% refund to Wallet
  • (c) Consultant rejects booking: 100% refund to Wallet
  • (d) Consultant no-show (does not join within 5 minutes): 100% refund to Wallet
  • (e) System auto-cancellation (consultant timeout): 100% refund to Wallet
  • (f) User no-show: 0% refund — Consultant is paid

6.3 All refunds are credited to the in-app Wallet instantly.

6.4 Refunds are not available as bank transfers or to the original payment method. The Wallet balance can be used for future Sessions.

7. CONSULTANT VERIFICATION

7.1 All Consultants undergo a verification process before being listed on the App.

7.2 Verification includes but is not limited to: confirmation of enrollment or graduation from a recognized Indian B-school, identity verification, and review of academic credentials.

7.3 The Company makes reasonable efforts to verify Consultant credentials but does not guarantee absolute accuracy.

7.4 Consultants are independent service providers and the Company is not responsible for their advice, opinions, or conduct.

8. USER CONDUCT

8.1 You agree not to:

  • (a) Use the App for any unlawful purpose
  • (b) Harass, abuse, or threaten any Consultant or other User
  • (c) Share personal contact information to bypass the platform
  • (d) Record Sessions without the consent of both parties
  • (e) Misrepresent your identity or qualifications
  • (f) Attempt to manipulate ratings or reviews
  • (g) Use automated tools, bots, or scripts to access the App
  • (h) Reverse engineer, decompile, or disassemble any part of the App

8.2 Violation of these rules may result in immediate account suspension or termination without refund.

9. INTELLECTUAL PROPERTY

9.1 The App, its content, features, functionality, design, and trademarks are owned by the Company and are protected by copyright, trademark, and other intellectual property laws.

9.2 You may not copy, modify, distribute, sell, or lease any part of the App.

9.3 Content shared during Sessions (advice, strategies, tips) is for personal use only and may not be commercially redistributed.

10. LIMITATION OF LIABILITY

10.1 The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding reliability, accuracy, or availability.

10.2 The Company shall not be liable for:

  • (a) Any advice or guidance provided by Consultants
  • (b) Admission outcomes, exam results, or career decisions made based on Sessions
  • (c) Technical issues, call drops, or connectivity problems
  • (d) Loss of data or unauthorized access to your account
  • (e) Any indirect, incidental, or consequential damages

10.3 Our total liability for any claim shall not exceed the amount you paid for the specific Session giving rise to the claim.

11. DISPUTE RESOLUTION

11.1 Users can report issues through the App's support section within 24 hours of a Session.

11.2 For call drop disputes, the system prompts both parties. Unresolved disputes are escalated to admin review.

11.3 Any legal dispute arising from these Terms shall be governed by the laws of India and subject to the exclusive jurisdiction of the courts in [Registered Office City].

12. PRIVACY

12.1 Your use of the App is also governed by our Privacy Policy, available at the Privacy Policy page.

13. MODIFICATIONS

13.1 The Company reserves the right to modify these Terms at any time. Updated Terms will be posted within the App and on the website.

13.2 Continued use of the App after modification constitutes acceptance of the updated Terms.

13.3 Material changes will be notified via push notification or email.

14. TERMINATION

14.1 The Company may suspend or terminate your account at any time for violation of these Terms.

14.2 You may delete your account at any time through the App's Settings, subject to wallet balance withdrawal and active booking cancellation.

14.3 Upon termination, your right to use the App ceases immediately.
