TERMS AND CONDITIONS

Please read these Terms and Conditions ("Terms") carefully before using the eSalahKaar mobile application ("App") operated by Bindal Mega Projects Private Limited ("Company", "we", "us", "our"), a company incorporated under the laws of India.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. DEFINITIONS

1.1 "App" means the eSalahKaar mobile application available on Google Play Store and Apple App Store, including all updates and modifications.

1.2 "User" or "Aspirant" means any individual who creates an account on the App to seek MBA guidance and consultation services.

1.3 "Consultant" means a verified current student or recent graduate of a recognized Indian B-school who provides guidance services through the App.

1.4 "Session" means a paid 1:1 consultation between a User and a Consultant, conducted via voice call or text chat through the App.

1.5 "Wallet" means the in-app digital wallet maintained by the Company for each User, used to pay for Sessions and receive refunds.

1.6 "Platform Fee" means the commission charged by the Company on each Session, currently set at 25% of the Consultant's base fee.

1.7 "GST" means Goods and Services Tax as applicable under Indian law, currently at 18% on consulting services (SAC Code: 998313).

2. ELIGIBILITY

2.1 You must be at least 18 years of age to use the App.

2.2 You must provide a valid Indian mobile phone number for account creation and verification.

2.3 By creating an account, you represent that all information provided is accurate, current, and complete.

2.4 The Company reserves the right to refuse service, terminate accounts, or cancel Sessions at its discretion.

3. ACCOUNT REGISTRATION

3.1 Accounts are created using phone number verification via One-Time Password (OTP).

3.2 You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3.3 You must notify us immediately of any unauthorized use of your account.

3.4 One account per phone number. Multiple accounts are not permitted.

3.5 Account deletion is available through the App's Settings. You must withdraw all wallet balance before deleting your account. Any active bookings will be cancelled and refunded before deletion proceeds.

4. SERVICES

4.1 eSalahKaar provides a marketplace platform connecting MBA aspirants with verified B-school student consultants.

4.2 The Company does not provide consulting services directly. Consultants are independent service providers, not employees or agents of the Company.

4.3 The Company does not guarantee the accuracy, quality, or outcome of any guidance provided by Consultants.

4.4 Sessions are available in two formats: (a) Scheduled Sessions — 15-minute fixed duration, booked in advance (voice call or chat); (b) Instant Calls — on-demand calls with online Consultants, billed per minute.

4.5 All session times are displayed in Indian Standard Time (IST).

5. PAYMENTS AND PRICING

5.1 Users pay for Sessions through the in-app Wallet. The Wallet can be topped up using UPI, debit cards, credit cards, or netbanking via Razorpay.

5.2 Minimum wallet top-up amount: ₹50.

5.3 Each Consultant sets their own per-minute rate. The Company does not impose minimum or maximum rates.

5.4 Total = Consultant Rate × Minutes × (1 + Platform Fee %) × (1 + GST %). Example (₹20/min, 15 min): Consulting ₹300 + Platform ₹75 + GST ₹67.50 = ₹442.50.

5.5 For Scheduled Sessions, the full amount is pre-paid at booking.

5.6 For Instant Calls, minimum 5 minutes wallet balance required. Billing starts on pickup. Partial minutes rounded up.

5.7 Unused wallet balance does not expire.

5.8 All payments in Indian Rupees (₹).

6. REFUND AND CANCELLATION

6.1 Full details at our Refund Policy page.

6.2 Summary: (a) User cancels before deadline (2 hrs before): 100% refund. (b) Consultant cancels: 100% refund. (c) Consultant rejects: 100% refund. (d) Consultant no-show: 100% refund. (e) System auto-cancellation: 100% refund. (f) User no-show: 0% refund.

6.3 All refunds credited to in-app Wallet instantly.

6.4 Refunds not available as bank transfers.

7. CONSULTANT VERIFICATION

7.1 All Consultants undergo verification before listing.

7.2 Verification includes enrollment/graduation confirmation, identity verification, academic credentials review.

7.3 The Company makes reasonable efforts but does not guarantee absolute accuracy.

7.4 Consultants are independent providers; the Company is not responsible for their advice or conduct.

8. USER CONDUCT

8.1 You agree not to: (a) Use the App unlawfully. (b) Harass any Consultant or User. (c) Share contact info to bypass the platform. (d) Record Sessions without consent. (e) Misrepresent identity. (f) Manipulate ratings. (g) Use bots or scripts. (h) Reverse engineer the App.

8.2 Violations may result in immediate account termination without refund.

9. INTELLECTUAL PROPERTY

9.1 The App and its content are owned by the Company and protected by IP laws.

9.2 You may not copy, modify, distribute, sell, or lease any part.

9.3 Session content is for personal use only.

10. LIMITATION OF LIABILITY

10.1 The App is provided "as is" and "as available."

10.2 The Company shall not be liable for: (a) Consultant advice. (b) Admission outcomes. (c) Technical issues. (d) Data loss. (e) Indirect damages.

10.3 Total liability shall not exceed the amount paid for the specific Session.

11. DISPUTE RESOLUTION

11.1 Issues reportable within 24 hours via the App.

11.2 Unresolved disputes escalated to admin review.

11.3 Legal disputes governed by Indian law, exclusive jurisdiction in [Registered Office City].

12. PRIVACY

13. MODIFICATIONS

13.1 The Company may modify Terms at any time.

13.2 Continued use = acceptance.

13.3 Material changes notified via push notification or email.

14. TERMINATION

14.1 The Company may suspend/terminate for violations.

14.2 You may delete your account via Settings.

14.3 Upon termination, your right to use ceases.
