Bindal mega projects Private Limited ("Company", "we", "us", "our"), a company incorporated under the Companies Act, 2013 (CIN: U45400UR2020PTC010635), operates the eSalahKaar mobile application ("App"). This Privacy Policy explains how we collect, use, store, share, and protect your personal information.

This Privacy Policy is published in compliance with the Information Technology Act, 2000, the IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (DPDP Act), as applicable.

By using the App, you consent to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide:
(a) Account Information: First name, last name, mobile phone number, email address, date of birth, gender, and profile photo.
(b) Payment Information: Wallet transaction history and payment method details. We do not store card numbers, CVV, UPI PINs, or banking credentials.
(c) Communication Data: Messages sent during chat Sessions, support tickets, and feedback.
(d) Referral Data: Referral codes shared and used.
1.2 Information Collected Automatically:
(a) Device Information: Device model, OS version, unique device identifiers, screen resolution, language settings.
(b) Usage Data: App features accessed, Session frequency, duration, pages viewed, actions taken.
(c) Location Data: Approximate location via IP address only. We do not access GPS or track physical movements.
(d) Log Data: Error logs, crash reports, performance data, diagnostics.
(e) Push Notification Tokens: Device tokens from Google FCM and Apple APNS.
(f) Crash and Performance Data: When the App crashes or encounters an error, diagnostic data is automatically collected, including error type, stack trace, device model, OS version, app version, and the actions leading to the crash. This data does not include your name, phone number, or personal information.
(g) Session Interaction Data: We may record anonymised session replays of how you interact with the App, including taps, scrolls, and screen navigation patterns. These recordings capture the App interface only and do not record your camera, microphone, keyboard inputs (such as passwords or messages), or any content outside the App. This data is used solely to identify usability issues and improve the App experience.
1.3 Information from Third Parties:
(a) Payment verification data from our third-party payment gateway.

2. How We Use Your Information

2.1 To provide, operate, and maintain the App.
2.2 To process payments and manage your Wallet.
2.3 To verify User identity and age during account creation.
2.4 To send transactional notifications (booking confirmations, reminders, refund alerts, OTPs, Wallet alerts).
2.5 To send promotional communications (offers, features, updates, referral information).
2.6 To provide customer support and respond to enquiries.
2.7 To improve the App through analytics and performance monitoring.
2.8 To detect and prevent fraud, abuse, and security incidents.
2.9 To resolve disputes using Session recordings and chat transcripts.
2.10 To comply with legal obligations and enforce our Terms.
2.11 To generate anonymised data for analytics, research, and marketing.
1.4 Device Permissions:
(a) Camera: The App requests access to your device camera solely to allow you to capture and upload a profile photo. We do not record, store, or transmit camera feed in any other context.
(b) Microphone: The App requests access to your device microphone solely for voice call Sessions. Microphone access is active only during a live voice call Session. We do not access the microphone outside of active Sessions.
(c) Storage / Photos: The App may request access to your device storage or photo library to allow you to select and upload a profile photo from your gallery.
(d) Notifications: The App requests permission to send push notifications for booking alerts, Session reminders, refund updates, and other communications as described in these Terms.

3. Session Data — Recordings and Chat

3.1 Voice call Sessions may be recorded for quality assurance and dispute resolution.
3.2 Chat messages are stored in encrypted form.
3.3 Session data is owned by the Company and may be used for dispute resolution, quality improvement, and analytics.
3.4 Anonymised Session data may be used for product improvement, training, marketing, and research.
3.5 By using the App, you consent to voice recording and chat storage.

4. Data Sharing

We do not sell, rent, or trade your personal data to any third party.
4.2 We share data only in these limited cases:
(a) With Consultants: Your first name and profile photo only. Phone, email, DOB, and other details are never shared.
(b) With Payment Processors: Information necessary for secure transaction processing.
(c) With Cloud Providers: Secure cloud hosting with industry-standard security.
(d) With Analytics Providers: Aggregated, anonymised data only. No personally identifiable information.
(e) With Law Enforcement: When required by law, court order, or government request.
(f) For Business Transfers: In event of merger, acquisition, or asset sale. You will be notified.
(g) With Crash Reporting Services: Anonymised crash and error diagnostic data is shared with third-party crash reporting services to help us identify and fix technical issues. No personally identifiable information is included.
(h) With Analytics and Usability Services: Anonymised interaction data (taps, scrolls, navigation patterns) may be shared with third-party analytics and usability services to help us understand how the App is used and improve the user experience. No personally identifiable information is shared.

5. Data Storage and Security

5.1 Data is stored on secure cloud infrastructure with servers in India.
5.2 Security measures include:
(a) Encryption in transit (TLS/SSL) and at rest.
(b) Row-level security and access control.
(c) Secure authentication with session tokens and OTP.
(d) Access logging, monitoring, and regular security reviews.
5.3 Voice recordings and chat messages are encrypted.
5.4 No method of storage is 100% secure. We use commercially reasonable measures but cannot guarantee absolute security.

6. Data Retention

6.1 Account Data: Deleted or anonymised within 30 days of account deletion.
6.2 Transaction Data: Retained for minimum 8 years (Indian tax/GST requirements).
6.3 Voice Recordings: Retained for 90 days, then permanently deleted.
6.4 Chat Transcripts: Retained for 1 year, then permanently deleted.
6.5 Support Tickets: Retained for 2 years from resolution.
6.6 Anonymised data may be retained indefinitely for analytics.

7. Your Rights

7.1 Access: View your data through the App's Account section.
7.2 Correction: Update your name in the App. Phone and email changeable via verification. DOB and gender cannot be changed.
7.3 Deletion: Request via Settings. Data deleted/anonymised within 30 days (except legally required data).
7.4 Data Portability: Request a copy by contacting support.
7.5 Withdraw Consent: Delete your account to withdraw consent. This affects your ability to use the App.

8. Children's Privacy

8.1 The App is for individuals aged 18 and above only. Age verification blocks registration for users below 18.
8.2 We do not knowingly collect data from individuals under 18. If discovered, we will delete it immediately.
8.3 Parents/guardians who believe their child provided data to us should contact us for prompt deletion.

9. Cookies and Tracking

9.1 The mobile App does not use browser cookies.
9.2 The website (esalahkaar.com) uses essential cookies and analytics tools. No personal data is collected via the website.

10. Third-Party Links

10.1 The App may link to third-party services. We are not responsible for their privacy practices.

11. Changes to This Policy

11.1 We may update this policy periodically. Changes will be posted within the App and on esalahkaar.com.
11.2 Continued use after changes constitutes acceptance. Material changes will be notified via push notification.

Complaints acknowledged within 24 hours. Data complaints addressed within 72 hours. All others resolved within 30 days.
