Privacy Policy

Bindal mega projects Private Limited ("Company", "we", "us", "our"), a company incorporated under the Companies Act, 2013 (CIN: U45400UR2020PTC010635), operates the eSalahKaar Consultant mobile application ("App"). This Privacy Policy explains how we collect, use, store, share, and protect your personal information.

This Privacy Policy complies with the Information Technology Act, 2000, the IT (Reasonable Security Practices) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (DPDP Act), as applicable.

1. Information We Collect

1.1 Information You Provide:
(a) Account Information: First name, last name, mobile phone number, email address, date of birth, gender, and profile photo.
(b) Verification (KYC) Documents: College ID card, enrolment letter, graduation certificate, government-issued identity proof (Aadhaar, PAN, Passport, Voter ID, or Driving Licence), and academic credentials (exam scorecard, programme details).
(c) Bank Details: Bank account number, IFSC code, account holder name, and bank name for processing withdrawal payouts.
(d) Profile Information: College name, programme, batch year, exam type, exam score, exam year, specialisation, bio, and per-minute rate.
(e) Communication Data: Messages sent during chat Sessions, support tickets, and feedback.
1.2 Information Collected Automatically:
(a) Device Information: Device model, OS version, unique device identifiers, screen resolution, language settings.
(b) Usage Data: App features accessed, Session frequency, duration, availability patterns, response rates.
(c) Location Data: Approximate location via IP address only. We do not access GPS or track physical movements.
(d) Log Data: Error logs, crash reports, performance data.
(e) Push Notification Tokens: Device tokens from Google FCM and Apple APNS.
(f) Crash and Performance Data: When the App crashes or encounters an error, diagnostic data is automatically collected, including error type, stack trace, device model, OS version, app version, and the actions leading to the crash. This data does not include your name, phone number, or personal information.
(g) Session Interaction Data: We may record anonymised session replays of how you interact with the App, including taps, scrolls, and screen navigation patterns. These recordings capture the App interface only and do not record your camera, microphone, keyboard inputs (such as passwords or messages), or any content outside the App. This data is used solely to identify usability issues and improve the App experience.

2. How We Use Your Information

2.1 To verify your identity, academic credentials, and B-school affiliation during KYC.
2.2 To create, maintain, and display your Consultant profile to Users.
2.3 To facilitate Sessions between you and Users.
2.4 To process earnings, manage your Wallet, and execute withdrawal payouts to your bank account.
2.5 To calculate and deduct Tax Deducted at Source (TDS), where applicable.
2.6 To send transactional notifications (booking requests, Session reminders, payout confirmations, KYC updates).
2.7 To send promotional communications (platform updates, feature announcements).
2.8 To provide customer support and respond to enquiries.
2.9 To improve the platform through analytics and performance monitoring.
2.10 To detect and prevent fraud, abuse, and platform violations.
2.11 To resolve disputes using Session recordings and chat transcripts.
2.12 To comply with legal obligations, tax regulations, and enforce our Terms.
1.3 Device Permissions:
(a) Camera: The App requests access to your device camera solely to allow you to capture and upload a profile photo. We do not record, store, or transmit camera feed in any other context.
(b) Microphone: The App requests access to your device microphone solely for voice call Sessions. Microphone access is active only during a live voice call Session. We do not access the microphone outside of active Sessions.
(c) Storage / Photos: The App may request access to your device storage or photo library to allow you to select and upload a profile photo from your gallery.
(d) Notifications: The App requests permission to send push notifications for booking alerts, Session reminders, refund updates, and other communications as described in these Terms.

3. Session Data — Recordings and Chat

3.1 Voice call Sessions may be recorded for quality assurance and dispute resolution.
3.2 Chat messages are stored in encrypted form.
3.3 Session data is owned by the Company and may be used for dispute resolution, quality improvement, and analytics.
3.4 Anonymised data may be used for product improvement, marketing, and research.
3.5 By using the App, you consent to voice recording and chat storage.

4. Data Sharing

We do not sell, rent, or trade your personal data to any third party.
4.2 We share data only in these limited cases:
(a) With Users: Your first name, last name, profile photo, college, programme, exam details, rating, per-minute rate, and availability are displayed on your public profile. Your phone number, email, DOB, bank details, and KYC documents are never shared with Users.
(b) With Payment Processors: Bank account details necessary for processing withdrawal payouts.
(c) With Cloud Providers: Secure cloud hosting with industry-standard security.
(d) With Tax Authorities: TDS details, PAN information, and earnings data as required by Indian tax laws. Form 16A is generated per quarter for TDS-applicable Consultants.
(e) With Law Enforcement: When required by law, court order, or government request.
(f) For Business Transfers: In event of merger, acquisition, or asset sale.
(g) With Crash Reporting Services: Anonymised crash and error diagnostic data is shared with third-party crash reporting services to help us identify and fix technical issues. No personally identifiable information is included.
(h) With Analytics and Usability Services: Anonymised interaction data (taps, scrolls, navigation patterns) may be shared with third-party analytics and usability services to help us understand how the App is used and improve the experience. No personally identifiable information is shared.

5. Data Storage and Security

5.1 Data is stored on secure cloud infrastructure with servers in India.
5.2 Security measures include encryption in transit and at rest, row-level security, access controls, OTP verification, and regular security reviews.
5.3 KYC documents are stored in encrypted form with restricted access. Only authorised admin personnel can access verification documents.
5.4 Bank details are encrypted and accessible only during withdrawal processing.
5.5 No method of storage is 100% secure. We use commercially reasonable measures but cannot guarantee absolute security.

6. Data Retention

6.1 Account Data: Deleted or anonymised within 30 days of account deletion.
6.2 KYC Documents: Retained for 7 years from account closure as required by Indian regulatory and financial compliance requirements.
6.3 Transaction and Payout Data: Retained for minimum 8 years (Indian tax/GST requirements).
6.4 Voice Recordings: Retained for 90 days, then deleted.
6.5 Chat Transcripts: Retained for 1 year, then deleted.
6.6 TDS Records: Retained for 8 years as per Income Tax Act requirements.
6.7 Anonymised data may be retained indefinitely for analytics.

7. Your Rights

7.1 Access: View your data through the App's Account section.
7.2 Correction: Update profile details through the App. KYC documents can be re-submitted for admin review.
7.3 Deletion: Request via Settings. Data deleted within 30 days (except legally required records).
7.4 Data Portability: Request a copy by contacting support.
7.5 Withdraw Consent: Delete your account. This affects your ability to use the App and receive payouts.

8. Children's Privacy

8.1 The App is for individuals aged 18 and above only.
8.2 We do not knowingly collect data from individuals under 18.

9. Changes to This Policy

9.1 We may update this policy periodically. Changes will be posted within the App.
9.2 Continued use constitutes acceptance. Material changes will be notified via push notification.

Complaints acknowledged within 24 hours. Data-related complaints addressed within 72 hours. All others resolved within 30 days.
